COVID-19 Waiver
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state and local governments and federal and state health agencies recommend social distancing and increased personal protection efforts, including frequent hand washing and wearing face coverings at all times outside the home.
Broward, Palm Beaches & St. Lucie Realtors® has put in place precautionary measures aimed at preventing and reducing the spread of COVID-19 among attendees’ protocols (see COVID-19 Event Code of Conduct) however, Broward Palm Beaches & St Lucie Realtors® cannot guarantee that you (or those you come in close contact with) will not become infected with COVID-19. Further, attending any Broward, Palm Beaches & St Lucie Realtors® event (including your travel to and from such event) could increase your risk of contracting COVID-19.
1. You acknowledge the contagious nature of COVID-19 and voluntarily assume all risk that you may be exposed to or infected by COVID-19 and that such exposure or infection may result in personal injury, illness, permanent disability, and death to you or those with whom you come into close contact.
2. You further acknowledge and agree to accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, to you or those with whom you come into close contact (including your household members) (“Claims”). You hereby release, covenant not to sue, discharge, and hold harmless the Broward Palm Beaches & St Lucie Realtors®, its employees, officers, board of directors, representatives, and members of, from and against any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You further understand and agree that this release includes any Claims based on actions, omissions or negligence of the Broward Palm Beaches & St Lucie Realtors®, its employees, officers, board of directors, representatives, and members, whether a COVID-19 infection occurs before, during, or after participation in any Broward, Palm Beaches & St Lucie Realtors® event.
3. You agree to abide by any and all posted rules, warning or instructions by the venue where the event is held and any government authority with respect to social distances, adherence to any dress code (including mandatory face coverings) and sanitation guidelines. You further agree not to attend the event if you are diagnosed with or suspect that you may have been infected by COVID-19, and in the event, you become ill or suspect you have been infected with COVID-19, you agree to immediately discontinue your participation in the event and alert the Broward Palm Beaches & St Lucie Realtors® via e-mail or telephone.
If you cannot agree to or are unwilling to accept and abide by the foregoing, DO NOT ATTEND any Broward, Palm Beaches & St Lucie Realtors® event. Failure to agree to or abide by any of the foregoing may result in denial of entry or immediate expulsion from the event at the sole discretion of the Broward, Palm Beaches & St Lucie Realtors®, in addition any and all remedies which may be available to Broward Palm Beaches & St Lucie Realtors®, in equity or at law.
COVID-19 Event Code of Conduct
While participating in events held or sponsored by the Broward, Palm Beaches & St. Lucie Realtors®, Inc. “social distancing” must be practiced. Limit table party size of 5-6 people or fewer. Face coverings are required to be worn in all public indoor spaces to reduce the risks of exposure to COVID-19. Face coverings may be removed while seated at socially distanced tables, only while eating or drinking. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Broward, Palm Beaches & St. Lucie Realtors® has put in place preventative measures to reduce the spread of COVID-19. However, Broward, Palm Beaches & St. Lucie Realtors® cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.
In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Broward, Palm Beaches & St. Lucie Realtors® events and/or other face to face fundraising activities. By attending a Broward, Palm Beaches & St. Lucie Realtors® event, you certify that you do not fall into any of the following categories:
1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath, among others.
2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or
3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
DUTY TO SELF-MONITOR:
Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and contact Broward, Palm Beaches & St. Lucie Realtors® if he/she experiences symptoms of COVID-19 within 14 days after participating or volunteering with Broward, Palm Beaches & St. Lucie Realtors®.

While participating in events held or sponsored by the Broward, Palm Beaches & St. Lucie Realtors® And Beaches MLS (collectively, “Realtors®”), consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and to wear face coverings to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Realtors® has put in place preventative measures as best it can in conformity with CDC guidelines in order to reduce the spread of COVID-19. However, Realtors® cannot guarantee that its participants, volunteers, partners, members or others in attendance will not become infected with COVID-19. In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage or participate in or attend any Realtors® events and/or other face to face organizational activities, and by attending a Realtors® event, you certify that you do not fall into any of the following categories: (1) Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath, among others; or, (2) Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care providers responsible for their treatment. Furthermore, by my attending a Realtors® event, I acknowledge, understand and agree to the following: (1) Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19 and while particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist and can never be eliminated; (2) I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of Realtors®, and its affiliated partners and sponsors, including in each case, without limitation, their directors, officers, employees, volunteers, agents, associates and members (collectively, the “Released Parties”); (3) I hereby knowingly assume the risk of injury, harm and loss associated with my participation in and/or attendance at events held or sponsored by Realtors®, , including but not limited to those related to illness and infectious diseases, such as COVID-19, even if caused by the negligence, fault or conduct of any kind on the part of the Released Parties; and, (4) I hereby release, waive and forever discharge the Released Parties of, from and against any and all liability, claims and demands of whatever kind or nature, including but not limited to those related to illness and infectious diseases, such as COVID-19.
