Understanding Delayed Marketing Exempt Listings: Limit Public Exposure, Keep Flexibility

Delayed Marketing Exempt Listing is a listing category introduced by the National Association of Realtors (NAR) following a settlement related to the Clear Cooperation Policy. This option allows sellers to restrict the internet marketing of their property, so it is only displayed on the listing broker’s website rather than across all public platforms. To facilitate this, MLS systems have added a new field called Delayed Marketing (Y/N), which indicates whether a property is being marketed under this exemption. This gives sellers more control over how and when their property is publicly advertised while still complying with MLS rules.

How to use Delayed Marketing

Sellers who wish to limit internet marketing for a set period must sign a Delayed Marketing Disclosure* before the MLS field can reflect Delayed Marketing = Yes.

For sellers who do not choose this option, the MLS field must be updated to reflect Delayed Marketing = No. Please note that the original Clear Cooperation Policy, which requires listings to be filed within one (1) business day, remains in effect.

Delayed Marketing FAQs

  • Delayed Marketing or DM is when a seller opts to delay the public marketing of their property by selectively displaying only on their listing broker’s website or other sites.

  • Yes, if the property is going to be publicly marketed, it must be in the MLS within one business day.

  • When entering a listing in the Coming Soon status, agents can select Delayed Marketing to ensure their listing is not included in IDX but can be included on their website.

  • When selecting Yes, the listing will not go out in IDX data feeds (other broker websites) but can be provided to the listing broker. It will also not display any listing history and allow showings/open houses.

  • No, the option is only available in Coming Soon.

  • Coming Soon status is maxed out at 21 days, so as long as you have not reached that cap, you can extend it.

  • No, once the listing is live, it cannot be changed. If it happened within 24 hours, we can remove the listing and have you re-enter it but keep in mind it might already be out on some websites.

  • No. Since the listing is in Coming Soon status, the Days on market do not calculate.

  • Yes, you can change the Yes to No while it’s still in Coming Soon status, however you will only be able to do that once.

  • Yes, you need the seller’s authorization in writing that indicates that seller understands they are waiving/delaying certain benefits before entering the listing into the MLS. Failure to obtain their authorization will result in a $1,000 fine.

  • Since it’s in Coming Soon status, the maximum number of days is 21. Once the listing goes Active, it’ll be included in the data feeds again.

  • Coming Soon is a

    status, and DM is a seller marketing option that

    exists within the Coming Soon status.
